Please read these terms and conditions carefully before booking an expedition with us.

Welcome to Jimny Himalayan Expeditions. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or booking an expedition, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Acceptance of Terms

By accessing and using the Jimny Himalayan Expeditions website and services, you accept and agree to be bound by these Terms of Service. These Terms apply to all visitors, users, and customers who access or use our services.

2. Booking and Payment Terms

Booking Process

  • All bookings are subject to availability and confirmation
  • Bookings are considered confirmed only after receipt of the required deposit or full payment
  • We reserve the right to refuse any booking at our discretion

Payment Terms

  • A non-refundable deposit is required at the time of booking
  • The remaining balance must be paid as specified in your booking confirmation
  • All prices are in Indian Rupees (INR) unless otherwise stated
  • Prices are subject to change without notice until booking is confirmed

3. Cancellation and Refund Policy

Cancellation by Customer

  • More than 30 days before departure: Deposit is non-refundable; balance refunded minus processing fees
  • 15-30 days before departure: 50% of total amount refunded
  • Less than 15 days before departure: No refund
  • All cancellation requests must be made in writing via email

Cancellation by Jimny Himalayan Expeditions

We reserve the right to cancel any expedition due to:

  • Insufficient bookings
  • Unfavorable weather conditions or natural disasters
  • Political instability or safety concerns
  • Government restrictions or regulations

In case of cancellation by us, you will receive a full refund or the option to transfer to another expedition date.

4. Participant Responsibilities

Participants are responsible for:

  • Ensuring they are physically and medically fit for the expedition
  • Disclosing any medical conditions, allergies, or physical limitations before booking
  • Following all safety instructions and guidelines provided by guides
  • Obtaining necessary permits, insurance, and travel documents
  • Respecting local cultures, customs, and the natural environment
  • Carrying appropriate travel insurance covering high-altitude activities
  • Not engaging in activities that endanger themselves or others

5. Safety and Risk Acknowledgment

IMPORTANT: High-altitude expeditions and treks involve inherent risks including, but not limited to, altitude sickness, extreme weather conditions, physical injury, and natural disasters. By participating, you acknowledge these risks and agree that Jimny Himalayan Expeditions, its guides, employees, and partners are not liable for any injury, loss, or damage resulting from participation in our expeditions.

We take safety seriously and provide trained guides, safety equipment, and emergency protocols. However, participants must understand that outdoor adventure activities carry inherent risks.

6. Health and Fitness Requirements

Participants must:

  • Be in good physical health and fitness appropriate for the expedition difficulty level
  • Consult with a physician before participating if they have any medical conditions
  • Inform us of any medical conditions, medications, or dietary restrictions
  • Obtain medical clearance for high-altitude activities if required
  • We reserve the right to refuse participation to anyone deemed unfit for the expedition

7. Itinerary Changes

We strive to follow the published itineraries; however, we reserve the right to modify or cancel any part of an itinerary due to weather conditions, safety concerns, natural disasters, political unrest, or other unforeseen circumstances. We will make reasonable efforts to provide alternative arrangements, but are not obligated to provide refunds for itinerary changes made for safety reasons.

8. Travel Insurance

We strongly recommend that all participants obtain comprehensive travel insurance covering:

  • Medical expenses and emergency evacuation (including high-altitude rescue)
  • Trip cancellation and interruption
  • Personal accident and liability
  • Loss or damage to personal belongings

Participants are responsible for ensuring their insurance adequately covers all activities planned during the expedition.

9. Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of Jimny Himalayan Expeditions and protected by copyright laws. Photographs and videos taken during expeditions may be used by us for promotional purposes unless you specifically request otherwise in writing.

10. Limitation of Liability

To the maximum extent permitted by law, Jimny Himalayan Expeditions, its directors, employees, guides, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your participation in our expeditions or use of our services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Himachal Pradesh, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
